As part of its activity and for the purpose of providing its Services, SMSlink Pacific collects and processes the personal data of its users (hereinafter the “Users”).
This privacy policy, implemented by SMSlink Pacific, is intended to provide Users with clear and comprehensive information about the processing of personal data carried out by SMSlink Pacific.
SMSlink Pacific places particular importance on respecting Users’ privacy and the confidentiality of their personal data, and undertakes to process such data in compliance with applicable laws and regulations, including Law No. 78-17 of January 6, 1978 on Information Technology, Data Files and Civil Liberties (hereinafter the “Data Protection Act”), and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (hereinafter the “GDPR”).

The controller of the personal data referred to herein is SMSlink Pacific, a limited liability company with a share capital of 120,000 Fcfp, registered with the RCS of Nouméa under number 1 625 367, with its registered office at 11 rue des Frères Maestrati, 98 800 Nouméa, New Caledonia.

SMSlink Pacific collects User data in order to provide them with the services they have subscribed to on the platform.
The mandatory or optional nature of the requested data (in order to finalize the User’s registration and provide SMSlink Pacific’s services) is indicated at the time of collection with an asterisk.
Additionally, certain data is collected automatically from the User’s actions on the website (see the section on cookies).
The personal data collected by SMSlink Pacific in the context of providing services is necessary for the performance of contracts concluded with the User, or to allow SMSlink Pacific to pursue its legitimate interests while respecting the User’s rights. Some data may also be processed based on the User’s consent.

The personal data collected is intended for SMSlink Pacific’s sales and accounting departments. It may be transmitted to subcontractors engaged by SMSlink Pacific for the provision of its services.
In this context, personal data may be transferred to a country within or outside the European Union. SMSlink Pacific implements safeguards to ensure the protection and security of this data, in compliance with regulations.
SMSlink Pacific does not sell or rent personal data to third parties for marketing purposes without the express consent of its Users.

To fulfill its legal obligations or to have the elements necessary to assert its rights, SMSlink Pacific may archive data under the conditions provided by regulations.
Thus, personal data collected by SMSlink Pacific relating to the identity and contact details of its Users are archived for a maximum of two years after the termination of contractual relations for client Users, or from their collection by the data controller or the last contact from the prospective User for such data.
Termination of contractual relations means the express termination of the contract by the User or the non-use of SMSlink Pacific’s services for a period of five years.
In accordance with regulations, the User has the rights of access and rectification of their personal data, allowing them to correct, complete, update, or delete data that is inaccurate, incomplete, ambiguous, outdated, or whose collection, use, communication, or storage is prohibited.
The User also has the right to request restriction of processing, and to object, on legitimate grounds, to the processing of their personal data. The User may also provide instructions regarding the handling of their personal data after their death.
Where applicable, the User may request data portability, or, where processing is based on consent, withdraw consent at any time.

SMSlink Pacific has taken all necessary precautions to preserve the security of personal data and, in particular, to prevent it from being distorted, damaged, or accessed by unauthorized third parties.
Furthermore, access to processing via SMSlink Pacific Services requires authentication of persons accessing the data using an individual access code and password, sufficiently robust and regularly updated.
